TAKE NOTICE that, in accordance with Section 28 of the Planning Act, R.S.O. 1990, as amended, Council of the Municipality of Wawa passed By-Law No. 3685-24 on the 19th day of March 2024, adopting a Downtown Wawa Community Improvement Plan.

AND TAKE NOTICE that any person or public body may appeal to the Ontario land Tribunal in respect of By-law 3685-24 by filing with the Clerk of the Municipality of Wawa not later than April 12, 2024, a Notice of Appeal setting out the reasons in support of the appeal accompanied by the fee prescribed under Ontario Land Tribunal and payable to the Minister of Finance. If the fee does not accompany the appeal, the Local Planning Appeal Tribunal has the power to dismiss the appeal pursuant to subsection 34 (25) o the Planning Act.

THE PURPOSE AND EFFECT of the Downtown Wawa Community Improvement Plan is to encourage revitalization and private investment on commercial properties along Broadway Avenue. The Downtown Wawa Community Improvement Plan includes a variety of financial incentive programs designed to support new investment the Downtown Area including Broadway and McKinley Avenues, and side streets between Algoma Street and Main Street.

IF A PERSON or public body did not make oral or written submissions to the Municipality of Wawa before the By-Law was passed, the person or public body is not entitled to appeal to the Ontario Land Tribunal. Only individuals, corporations, and public bodies may appeal the By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. A Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the appeal hearing unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
