Notice of Passing of By-Law 3897-26 - 39 Algoma Community Improvement Plan

TAKE NOTICE that, in accordance with Section 28 of the Planning Act, R.S.O. 1990, as amended, Council of the Municipality of Wawa passed By-Law No. 3897-26 on the 11^th day of August 2026, adopting the 39 Algoma Community Improvement Plan.

AND TAKE NOTICE that qualifying persons and public bodies may appeal to the Ontario Land Tribunal in respect of By-law 3897-26 by filing with the Clerk of the Municipality of Wawa a Notice of Appeal setting out the reasons in support of the appeal, accompanied by the fee prescribed under Ontario Land Tribunal made payable to the Minister of Finance by SEPTEMBER 1, 2026, 4:30 p.m. If the fee does not accompany the appeal, the Local Planning Appeal Tribunal has the power to dismiss the appeal pursuant to subsection 34 (25) of the Planning Act.

THE PURPOSE AND EFFECT of the 39 Algoma Community Improvement Plan (CIP) is to support residential housing development on the property located at 39 Algoma Street by providing approved financial incentives to facilitate housing development. The CIP includes two financial incentive programs to support new housing to be built, subject to conditions being met.

WHO MAY APPEAL - Only the Minister, the applicant, specified person and public bodies as defined in the Planning Act, and registered owners of lands to which the by-law will apply and who made submissions at a public meeting or who have made written submissions to the Municipality before the by-law was passed, will be able to appeal the decision of the Municipality of Wawa to the Ontario Land Tribunal. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.      

IF A PERSON or public body did not make oral or written submissions to the Municipality of Wawa before the By-Law was passed, the person or public body is not entitled to appeal to the Ontario Land Tribunal. Only individuals, corporations, and public bodies may appeal the By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. A Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the appeal hearing unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
