NOTICE OF PASSING OF ZONING BY-LAW AMENDMENT
MUNICIPALITY OF WAWA
Amendment to Zoning By-Law for a Residential Dwelling in General Industrial Zone (M1)
TAKE NOTICE that on the 17th day of March 2026, The Corporation of the Municipality of Wawa adopted By-Law No. 3868-26 under Section 34 of the Ontario Planning Act to add
Section 8.105 to the Wawa Zoning By-law No. 2821-15 by adding:
1. 8.105 General Industrial (M1) Exception Symbol*105
Notwithstanding any other provision of this by-law, on lands denoted with the symbol *105 on Schedule “A-1” one residential unit is a permitted use on property zoned General Industrial (M1) described as Lot 1451, Parcel 1298 MICH, Plan-M168, known as 50 Montreal Avenue
2. THAT Schedule A-1 of By-law Number 2821-15 of The Corporation of The Municipality of Wawa is hereby amended in accordance with Schedule “A”, attached and forming an integral part of this By-law, by rezoning the subject property located at 50 Montreal Avenue in Wawa from General Industrial (M1) Zone to General Industrial Exception *105 (M1-105).
THE PURPOSE AND EFFECT of the Zoning By-law Amendment is to amend Wawa Zoning By-law 2821-15 to permit additional uses in the M1 General Industrial Zone for the subject lands of 50 Montreal Avenue, described as Lot 1451, Parcel 1298 MICH, Plan M168, which would add Residential Dwelling as a permitted use in the M1 General Industrial Zone.
TAKE NOTICE that appeals to the Ontario Land Tribunal in respect of the By-Laws may be made by filing a written notice of appeal with the Clerk of the Municipality of Wawa, no later than the 8th day of April, 2026, setting out the reasons for the appeal and accompanied by the Ontario Land Tribunal Appellant Form (A1) and required fee made payable to the Minister of Finance. This form is available on-line at https://olt.gov.on.ca/.
IF A PERSON or public body did not make oral or written submissions to the Municipality of Wawa before the By-Law was passed, the person or public body is not entitled to appeal to the Ontario Land Tribunal. Only individuals, corporations, and public bodies may appeal the By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. A Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
